Qualifying Criteria
To qualify for a nonprofit license, an organization must meet the following criteria:
- Nonprofit Status:
- The organization must be legally registered as a nonprofit entity under the applicable laws of its country of operation (United States of America).
- Proof of nonprofit status, such as a 501(c)(3) designation in the United States or equivalent documentation, must be provided.
- Mission and Activities:
- The primary mission of the organization must be charitable, educational, scientific, or focused on public welfare.
- The organization's activities should align with its stated mission and contribute positively to the community or target population it serves.
- Governance:
- The organization must have a governing body (e.g., board of directors) that operates independently from any individual or for-profit entity.
- The governing body should consist of a minimum of three members who are not related by blood or marriage.
- Transparency and Accountability:
- The organization must demonstrate a commitment to transparency by making its financial statements, annual reports, and other relevant documents publicly available.
- The organization must comply with all reporting requirements set by regulatory authorities in its jurisdiction.
- Non-Distribution Constraint:
- The organization must not distribute profits or earnings to individuals, members, directors, or officers, except as reasonable compensation for services rendered.
- Operational History:
- The organization must have a minimum operational history of one year, during which it has actively pursued its mission and objectives.
- Public Support:
- The organization must show evidence of public support through donations, grants, or volunteer involvement.
- The organization should not be primarily funded by a single source or individual.
- Non-Discrimination Policy:
- The organization must have a policy of non-discrimination in place, ensuring equal access and opportunity regardless of race, gender, religion, disability, sexual orientation, or other protected characteristics.
- Use of License:
- The organization must agree to use the nonprofit license solely for support of its current employees.
- The license cannot be transferred, sold, or used for commercial purposes.
- Compliance:
- The organization must agree to comply with all terms and conditions associated with the nonprofit license.
- The organization must promptly notify the licensing authority of any significant changes in its status, mission, or operations that may affect its eligibility.
